In this privacy policy, we describe our privacy policy. We seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this privacy policy that you do not agree with, please discontinue use of our Sites and our services. This privacy policy applies to all information collected through our website (such as www.notifyme.tech), and/or any related services, sales, marketing or events (we refer to them collectively in this privacy policy as the “Sites”).

1. WHAT INFORMATION DO WE COLLECT?

The personal information you disclose to us

We collect personal information that you provide to us such as name, address, contact information, passwords and security data, and payment information.

We will activate a forum where users after registration can discuss a software (eg Usability, problems, support,). NotifyMe moderates the forum and the questions and answers will be visible to all users. We collect personal information that you voluntarily provide to us when registering at the Sites expressing an interest in obtaining information about us or our products and services when participating in activities on the Sites (such as posting messages in our online forums or entering competitions, contests or giveaways) or otherwise contacting us. The personal information that we collect depends on the context of your interactions with us and the Sites, the choices you make and the products and features you use. The personal information we collect may include the following:

Name and Contact Data.  We collect your first and last name, email address, postal address, phone number, and other similar contact data. Information and documents used by the user to work using NotifyMe can be entered manually or automatically via API (application program interface).

Information and content you provide.  The Service allows you to upload or input information, text, files, and other materials (together, the “Content”). We collect the content, communications and other information you provide when you use our Product, including when you sign up for an account, create or share content, and message or communicate with others. This can include information in or about the content you provide (like metadata), such as the location of a photo or the date a file was created. If you are using the Services in connection with an account created by a NotifyMe Customer (e.g., employer, organization, or an individual), we collect and process the Content you submit on behalf of the Customer. As described more throughout this Policy, our Customers, and not NotifyMe, determine their own policies regarding storage, access, modification, deletion, sharing, and retention of Content which may apply to your use of the Services. For example, a Customer may provide or remove access to the Service, manage permissions, assign teams or share projects. Please check with the Customer about the policies and settings that they have instituted with respect the Project data that you provide when using the Service.

 

Things others do and information they provide about you. We also receive and analyse content, communications and information that other people provide when they use our Product. This can include information about you, such as when others send a message to you, or upload, sync or import your contact information. We require each of these users and businesses to have lawful rights to collect, use, and share your information before providing any information to us.

Information we collect from Third-Party Integrations. If you choose to use third-party integrations through the Services or are required to do so by a Customer, such providers may allow us and our service providers to have access to and store additional information about your interaction with those services and platforms as it related to use of the Services. If you do not wish to have this information shared, do not initiate these connections.

 

Information we collect from affiliates and non-affiliated Third Parties. NotifyMe may receive additional information about you, such as demographic information, from affiliates under common ownership and control, and from third parties, such as business partners, marketers, researchers, analysts, and other parties that we may use to supplement the information that we collect directly from you.

 

Networks and connections. We collect information about people, projects and accounts you are connected to and how you interact with them across our Product, such as people you communicate with the most or groups you are part of.

Credentials.  We collect passwords, password hints, and similar security information used for authentication and account access.

Payment Data. We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All payment data is stored by our payment processor and you should review its privacy policies and contact the payment processor directly to respond to your questions.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

Some information — such as IP address and/or browser and device characteristics — is collected automatically when you visit our Sites.

We automatically collect certain information when you visit, use or navigate the Sites. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Sites and other technical information. This information is primarily needed to maintain the security and operation of our Sites, and for our internal analytics and reporting purposes. Information collected from other sources

We may collect limited data from public databases, marketing partners, and other outside sources. 

We may obtain information about you from other sources, such as public databases, joint marketing partners, as well as from other third parties. Examples of the information we receive from other sources include social media profile information; marketing leads and search results and links, including paid listings (such as sponsored links).

2. HOW DO WE USE YOUR INFORMATION?

We process your information for purposes based on legitimate business interests, the fulfilment of our contract with you, compliance with our legal obligations, and/or your consent.

We use personal information collected via our Sites for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests (“Business Purposes”), in order to enter into or perform a contract with you (“Contractual”), with your consent (“Consent”), and/or for compliance with our legal obligations (“Legal Reasons”). We indicate the specific processing grounds we rely on next to each purpose listed below.

We use the information we collect or receive:

  • To provide our services. We use the information we have to maintain, provide and improve our Services, including providing customer support, and improving, fixing, and customizing our Services. We also use your information to respond to you when you contact us. To investigate when we have a good faith belief, or have received a complaint alleging, that such your Content is in violation of our Terms of Service.

  •  To communicate with you. We can use your information to communicate with you via email and through the Service about important notices and updates regarding the Service, such as to inform you about changes in the Service, our service offerings, and important services-related notices, such as about security and fraud. Because these communications are an important part of the Service, you may not opt out of them.

  • To send you marketing and promotional communications. We and/or our third-party marketing partners may use the personal information you send to us for our marketing purposes if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time (see the “WHAT ARE YOUR PRIVACY RIGHTS” below).

  • To send administrative information to you. We may use your personal information to send you a product, service and new feature information and/or information about changes to our terms, conditions, and policies.
  • Fulfil and manage your orders. We may use your information to fulfil and manage your orders, payments, returns, and exchanges made through the Sites.
  • To post testimonials. We post testimonials on our Sites that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and testimonial. If you wish to update or delete your testimonial, please contact us at legal@notifyme.tech and be sure to include your name, testimonial location, and contact information.
  • Request Feedback. We may use your information to request feedback and to contact you about your use of our Sites.
  • To protect our Sites. We may use your information as part of our efforts to keep our Sites safe and secure (for example, for fraud monitoring and prevention).
  • To enable user-to-user communications. We may use your information in order to enable user-to-user communications with each user’s consent.
  • To enforce our terms, conditions and policies.
  • To respond to legal requests and prevent harm. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.
  • For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Sites, products, services, marketing and your experience.
  • For analytics. We use third-party web analytics services (e.g., Google Analytics) on our Services to collect and analyze the information discussed above, and to engage in auditing, research and reporting. The information (including your IP address) collected by various analytics technologies described in the “Cookies and Similar Technologies” section will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Services, including by noting the third-party website from which you arrive, analyzing usage trends across NotifyMe products and mobile devices, assisting with fraud prevention, and providing certain features to you. To prevent Google Analytics from using your information for analytics, you may install the Google Analytics Opt-out Browser Add-on by clicking here. If you receive email from us, we may use certain analytics tools, such as clear GIFs to capture data such as when you open our message or click on any links or banners our email contains. This data allows us to gauge the effectiveness of our communications and marketing campaigns.

  • Public Forums. The Services may make it possible for you to upload and share comments or feedback publicly (i.e., outside of the NotifyMe web app) with other users, such as on a blog or help community. Any information that you submit through such public features is not confidential, and NotifyMe may use it for any purpose (including in testimonials or other NotifyMe marketing materials) after obtaining your consent. Any information you post openly in these ways will be available to the public at large and potentially accessible through third-party search engines. Such information can be read, collected and/or used by other users, and it could be used to send you unsolicited messages. Accordingly, please take care when using these features of the Services. We urge you to consider the sensitivity of any information you input into these Services. To request removal of your information from publicly accessible websites operated by us, please contact us as provided below. In some cases, we may not be able to remove your information, in which case we will let you know if we are unable to and why.

3. WILL YOUR INFORMATION BE SHARED WITH ANYONE?

We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfil business obligations.

NotifyMe is a tool to make teams collaborate, the information entered by a user in his account can be shared with other users in their account. We may process or share your data that we hold based on the following legal basis:

  • Consent: We may process your data if you have given us specific consent to use your personal information for a specific purpose.
  • Legitimate Interests: We may process your data when it is reasonably necessary to achieve our legitimate business interests.
  • Performance of a Contract: Where we have entered into a contract with you, we may process your personal information to fulfil the terms of our contract.
  • Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal processes, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
  • Vital Interests: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

More specifically, we may need to process your data or share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • Vendors, Consultants and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include payment processing, data analysis, email delivery, hosting services, customer service and marketing efforts. We may allow selected third parties to use tracking technology on the Sites, which will enable them to collect data about how you interact with the Sites over time. This information may be used to, among other things, analyse and track data, determine the popularity of certain content and better understand online activity. Unless described in this Policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes.

  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honour this privacy policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

  • Other Users. When you share personal information (for example, by posting comments, contributions or other content to the Sites) or otherwise interact with public areas of the Sites, such personal information may be viewed by all users and may be publicly distributed outside the Sites in perpetuity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our Sites, and view your profile.

4. WHO WILL YOUR INFORMATION BE SHARED WITH?     

We may share information formation we collect from Subscribers as follows:

  • People and accounts you share and communicate with. When you share and communicate using our Product, you choose the audience for what you share. When you agree to take part in Project on the Service, your information will be shared with the users who are involved in the same Project. For example, when you share a document you can choose who can read it, when you add info to a task you can see which are other people involved in that task.
  • Content others share or reshare about you. You should consider who you choose to share with, because people who can see your activity on our Products can choose to share it with others. For example, when you share a document or send a message to specific people or accounts, they can download, screenshot, or reshare that content to others across or off our Product.
  • Consistent with your settings within the Service. Please note that the Project Content you submit through the Service may be viewable by other users in your project and within your organization, depending on the specific settings you and your organization have selected.
We only share and disclose your information with the following third parties. We have categorised for each party so that you may easily understand the purpose of our data collection and processing practices. If we have processed your data based on your consent and you wish to revoke your consent, please contact us.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

We may use cookies and other tracking technologies to collect and store your information.

6. HOW LONG DO WE KEEP YOUR INFORMATION?

We keep your information for as long as necessary to fulfil the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than the period of time in which users have an account with us.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

If your account is deactivated or disabled, some of your information and the contents you have provided will remain in order to allow your team members or other users to make full use of the Services.  For example, we continue to display messages you sent to the users that received them and continue to display content you provided. If the Services are made available to you through an organization (e.g., your employer), we retain your information as long as required by the administrator of your account.  

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

We aim to protect your personal information through a system of organisational and technical security measures.

We have implemented appropriate technical and organisational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, the transmission of personal information to and from our Sites is at your own risk. You should only access the services within a secure environment.

Below, you can read an overview of our security model as well as mechanisms and processes we have implemented to help ensure that your data is protected. If you have any questions about security on our Services, you can contact us at support@notifyme.org.

  • Encrypted Traffic. Access to your data on our Services is password-protected, protected by SSL encryption when it is exchanged between your web browser and the Services. As We use 3rd party services for processing future payments, your financial information and data such as credit card information will be stored in encrypted form on secure servers of our reputed Payment Gateway Service Provider.To protect any data you store on our servers, we also regularly monitor our system for possible vulnerabilities and attacks. However, since the Internet is not a 100% secure environment, we cannot ensure or warrant the security of any information that you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. It is your responsibility to protect the security of your login information. Please note that emails and similar means of communication with other Members are not encrypted, and we strongly advise you not to communicate any confidential information through these means.
  • Secure Physical Location. Our datacenters are hosted in some of the most secure facilities available today in locations that are protected from physical and logical attacks as well as from reasonable natural disasters such as earthquakes, fires, floods, etc.
  • Availability. We are committed to making NotifyMe’ software a highly available service that you can always count on. We take measures and build the product to tolerate a failure of individual components and we make sure to keep the service up while doing maintenance work on our infrastructure.
  • Data Protection. We know the data you share in NotifyMe software is private and confidential. We limit access to customer data to only a select few of our employees with the highest clearance. Employee access is logged and passwords are strictly regulated and we are committed to ensuring that your data is never seen by anyone who should not see it. With that said, the operation of NotifyMe’ software wouldn’t be possible without a few members having access to our databases in order to optimize performance and storage. This team is prohibited from using these permissions to view customer data without explicit, written permission from the user. You are responsible for maintaining backups of your data present on the space made available by the Service; you may download such data at any time following the procedures for data backup.

8. Account Information

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log into your account settings and update your user account.
  • Contact us using the contact information provided.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Sites. Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list — however, we will still need to send you service-related emails that are necessary for the administration and use of your account. To otherwise opt-out, you may:

  • Access your account settings and update preferences.
  • Contact us using the contact information provided.

9. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practise in a revised version of this Privacy Policy.

10. DO WE MAKE UPDATES TO THIS POLICY?   

Yes, we will update this policy as necessary to stay compliant with relevant laws.

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.

12. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, change that information, or delete it in some circumstances. To request to review, update, or delete your personal information, please please visit notifyme.tech. We will respond to your request within 30 days.

When you delete your account, we delete your personal data along with your account or if you choose to request us to delete your personal data we delete such data after reviewing your request. However, please note that under certain circumstances it is impossible for us to delete all contents such as files, username, data or messages. We are unable to delete such information primarily because of three reasons: (i) we have our legitimate interests involved to keep such information, (ii) such information is necessary in relation to the purposes for which it was collected or processed, and/or (iii) it is inevitable for us to keep such information for the purposes of providing our Services to the other users. Our Service is aimed at providing a collaborative tool in order to primarily increase business process digitalization therefore, such information is necessary, for us to pursue our legitimate interests. In addition to this, such Information that others have shared about you isn’t part of your account and won’t be deleted.

If your account is deactivated or disabled, some of your information and the content you have provided will remain in order to allow your team members or other users to make full use of the Services. For example, we continue to display messages you sent to the users that received them and continue to display content you provided. If the Services are made available to you through an organization (e.g., your employer), we retain your information as long as required by the owner of your account.

13. HOW CAN YOU EXERCISE YOUR RIGHTS PROVIDED UNDER THE GDPR?

Under the General Data Protection Regulation, you have the following rights:

The Right to be informed
You have the right to be informed about what we do with your personal data. We collect data that has been expressly mentioned in this Privacy Policy. In circumstances, when the data is directly collected we provide you with a reasonable notice immediately or within a reasonable time as the case may be. You also retain the right to be informed about how long we keep the data we collect by use or access of this website.

The Right to Access
If you want to know that how we process your data, it is your legitimate right to request a copy of your data which is being processed. We will provide you such information electronically.
The Right to Rectification
If your data on our site is inaccurate or incomplete, you reserve the right to rectify the same. You can make a request to rectify your inaccurate or incomplete data. We may take upto one month to respond to your request.

The Right to Erasure
We recognise the importance of receiving a request for erasure and understand when this right applies. We have a reasonable process to ensure that we respond to your request for erasure within one month and without any unnecessary and undue delay. We have appropriate methods to erase the data.

The Right to Restrict Processing
You have the right to request the restriction of the processing of your data. Once we receive your request, we will respond within one month without any unnecessary delay. We have procedures in place to inform any recipients if we restrict any data we have shared with them.

The Right to Request for Data Portability
It is standard practice to transmit the data in structured, commonly used and machine-readable formats. We use secure methods to transmit data according to the standards available. You have the right to obtain and reuse your personal data for your own purposes across different services and ask us to transmit the same. However, this right only applies to the data you have provided to us.

If you are using the Services in connection with an account created by a NotifyMe Customer, please contact your Project owner(s) or administrator(s) to exercise any data subject rights you have under applicable local laws, including your ability to access, delete, rectify, transfer, or object under the GDPR.
